1. Reasons for Amendment

With the Whole Amendment from the Maritime Safety Act to the Framework Act on Maritime Safety (Act No. 19572; promulgated on July 25, 2023), this Whole Amendment aims to define matters delegated from the Act and required for its implementation and to improve and supplement some of the shortcomings found in the operation of the current system.   



2. Major Provisions


A. Newly insert the scope and method of maritime safety inspection (Article 2)


B. Newly insert documents and procedures about an application for a training institution for maritime safety management professionals (Article 3) 


C. Newly insert those subject to safety investment disclosure to operate the safety investment disclosure scheme, the scope and items of safety investment, and disclosure procedures for safety investment (Article 6)


1) Define those subject to safety investment disclosure as those subject to external audit under Article 4 Paragraph 1 of the Act on External Audit of Stock Companies among those doing business in marine passenger transportation services under Article 2 Subparagraph 2 of the Marine Transportation Act and those determined and notified by the Minister of Oceans and Fisheries subject to external audit under Article 4 Paragraph 1 of the Act on External Audit of Stock Companies among those doing business in marine cargo transportation services under Article 2 Subparagraph 3 of the Marine Transportation Act.


2) Specify the scope and items of safety investment into vessel management, human resources management, and safety quality management, and require the Minister of Oceans and Fisheries to notify detailed disclosure criteria.


3) Require those subject to safety investment disclosure to disclose the details of safety investment for the previous year in the Maritime Transportation Safety Information System and their website by the end of June every year.


D. Newly insert criteria and methods to reward those who greatly contributed to maritime safety (Article 7).
