1. Reasons for Amendment

As the fishing gear deposit scheme will be enforced from January 12, 2024 with the Whole Amendment to the Fisheries Act (promulgated on January 11, 2022), this Partial Amendment aims to define details for the implementation of the fishing gear deposit scheme as delegated from the Act, such as the amount of fishing gear deposit and handling fees, update the name from fish farm dredge net vessel to village fishing ground dredge net vessel with the Aquaculture Industry Development Act, correct the permit quota of 6 cases for lift net fishery misclassified as long net fishery in Gyeongsangnam-do, and improve and supplement some of the shortcomings found in the operation of the current system.

2. Major Provisions

A. Update the name from fish farm dredge net vessel to village fishing ground dredge net vessel (Article 19, Table 3).

B. Classify the fishing gear deposit based on the type of fish trap (Article 85-2).

C. Specify a specific method for reimbursing the fishing gear deposit if fishing gear is lost due to natural or other disasters (Article 85-3).

D. Define things to be considered to notify the cost (handling fees) required to place a label on fishing gear subject to the fishing gear deposit (Article 85-4).

E. Specifically define the calculation equation for the non-refundable deposit in the year and incorporate required matters, including the non-refundable deposit use plan and performance reporting method for the Fishing Gear Deposit Management Center (Article 85-5).

F. Specify projects deemed by the Minister of Oceans and Fisheries necessary to operate the fishing gear deposit scheme (Article 85-6).

G. Define a specific application procedure to receive financial and technical support from the Fishing Gear Deposit Management Center (Article 85-7).

H. Increase the permit quota for lift net fishery to 6 cases in Gyeongsangnam-do, correct the reduced sum of long net fishery, and update some shortcomings in provisions (Table 8, Table 9).
