1. Reasons for Amendment and Major Provisions


As the Clean Air Conservation Act (Act No. 19660, promulgated on August 16, 2023; to be enforced on February 17, 2024) and the Enforcement Decree of the same Act (Presidential Decree No. 000, promulgated on 00 00, 2023; to be enforced on 00 00) were revised to require a person who intends to import exhaust gas reduction devices, low emission engines and engine-idling control devices to obtain certification from the Minister of Environment. This amendment aims to specify details such as the deadline of the order to take measures and submission of an action plan concerning uncertified exhaust gas reduction devices. It also orders persons who intend to manufacture, import, supply, or sell uncertified exhaust gas reduction devices to take necessary measures, such as recalling or disposing of the products. 


Where the Minister of Environment cancels the registration of an electric vehicle that has received a purchase subsidy for export purposes, the scope of the period for compulsory operation of the motor vehicle is increased from the current 5 years to 8 years and the corresponding recovery ratio of subsidy is set. The real driving emissions standards for small and medium-sized diesel motor vehicles are strengthened. It also addresses and improves upon a number of weaknesses that have emerged from the operation of the current system.
