1. Reasons for Proposal
The Special Act on Support for Agricultural and Fisheries Employees was enacted (Act No. 19224; promulgated on February 14, 2023; to be enforced on February 15, 2024) to ensure systematic implementation of development and support policies for agricultural and fisheries employees by prescribing grounds to conduct surveys and to support and operate agricultural and fisheries employee support centers and specialized employee support agencies. Accordingly, this Decree prescribes matters delegated by the Act and matters necessary for the enforcement thereof.
2. Major Provisions
A. Prescribe deliberations on agricultural and fisheries employee support master plans and action plans, and specify matters to be included in Si/Do plans and Si/Gun/Gu plans under Article 5 of the Act (Article 2, Article 3).
B. Specify the frequency, scope, method, scope of data requests, etc. of agricultural and fisheries employee survey under Article 6 of the Act (Article 4).
C. Specify details on government support for work carried out by local governments to utilize foreign national agricultural and fisheries employees under Article 10 of the Act (Article 5).
D. Specify standards for the designation and revocation of agricultural and fisheries employee support centers under Article 12 of the Act (Article 6 to Article 7).
E. Specify details on consultation and support to protect the human rights of agricultural and fisheries employees under Article 13 of the Act, and prescribe that such affairs may be delegated to the heads of specialized agricultural and fisheries employee support agencies or other relevant specialized institutions (Article 8).
F. Specify the selection method for identifying agricultural and fisheries business entities that provide an excellent working environment under Article 17 of the Act, and prescribe the details in a notice (Article 9).
G. Select commendable employees from among those who have worked for an agricultural or fisheries business entity for 3 years or more, and prescribe the assessment procedure and other details in a notice (Article 10).
H. Prescribe grounds to handle personal information for the collection and analysis of information on agricultural and fisheries employees and their employers under Article 12 of the Act, and for the establishment and operation of an integrated agricultural and fisheries employees’ system under Article 20 of the Act (Article 11).
I. Specify standards on the designation and revocation of specialized agricultural and fisheries employee support agencies under Article 21 of the Act (Article 12 to Article 13).
