1. Reasons for Amendment and Major Provisions
The Military Pension Act was amended (Act No. 19788; promulgated on October 31, 2023; to be enforced on May 1, 2024) to enhance fairness among beneficiaries of retirement benefits for survivors by prescribing that payment of such retirement benefits may be denied, in full or in part, to survivors who fail to fulfill their parental responsibilities, and to allow the Minister of National Defense to make direct requests for medical records and other information from intermediate care institutions. Accordingly, this Amendment prescribes a procedure for limiting payment of retirement benefits for survivors who fail to fulfill their parental responsibilities, stipulates other matters delegated by the Act and matters necessary for the enforcement thereof, and addresses and improves upon a number of operational weaknesses.
