1. Reasons for Amendment

  The Railroad Safety Act was amended (amended on April 18, 2023) to mandate inspections of packaging and containers for hazardous substances and training of employees who handle hazardous substances. Accordingly, this Amendment prescribes details delegated to subordinate legislations, such as the method of inspection of hazardous substance containers, designation of inspection bodies, and training of employees who handle hazardous substances, thereby aiming to make improvements to ensure smooth implementation of the system.


2. Major Provisions

 A. Newly insert matters concerning inspections of hazardous substance containers and the scope of exemption (Article 6-2, Article 6-3)

Prescribe the acceptance criteria, methods, procedures, scope of exemption, etc. for inspections of the packaging and containers of hazardous substances transported by railroads as delegated by the amended Railroad Safety Act to the Ordinance of the Ministry of Land, Infrastructure and Transport.


 B. Newly insert matters concerning the designation, revocation of designation, and other dispositions for inspection bodies (Article 20, Article 21)

   Prescribe designation standards and procedures, revocation of designation, and other disposition standards for inspection bodies specializing in the packaging and containers of hazardous substances transported by railroad as delegated by the amended Railroad Safety Act to the Ordinance of the Ministry of Land, Infrastructure and Transport.


 C. Newly insert the scope of persons subject to training for employees who handle hazardous substances and the course content (Article 22)

Prescribe detailed matters to ensure smooth delivery of training by clarifying the scope of persons subject to training for employees who handle hazardous substances, course content, method, timing, etc. as delegated by the amended Railroad Safety Act to the Ordinance of the Ministry of Land, Infrastructure and Transport.


 D. Newly insert matters concerning the designation of specialized training centers, revocation of designation, and other dispositions (Article 23, Article 24)

Prescribe detailed matters concerning designation standards and procedures, revocation of designation, and other disposition standards for specialized training centers for employees who handle hazardous substances transported by railroad as delegated by the amended Railroad Safety Act to the Ordinance of the Ministry of Land, Infrastructure and Transport.
