1. Reasons for Amendment

This amendment aims to provide sub-legislation stipulating the “private discharge facilities prescribed by Ordinance of the Ministry of Environment” delegated by this Act in a timely manner due to the revision of Article 21 (1) of the Special Act on Fine Dust Reduction and Management (promulgated on January 9, 2024; the enforcement date shall be six months after the promulgation date).

2. Major Provisions

A. Set the scope of private discharge facilities as discharge facilities operated by Types 1 and 2 business places under Article 25 of the Air Quality Conservation Act (Article 12 (1) newly inserted).

B. The period for the Minister of Environment’s request is changed from the current seven days in advance to 30 days in advance to provide business places sufficient preparation time (Article 12 (3) revised).
