1. Reasons for Amendment

As the International Ship and Port Facility Security Act was revised to eliminate security threats at port facilities, such as the distribution of video footage of ports, and respond to new threats, such as drones, this amendment aims to prescribe matters delegated by the Act such as standards for port facility security officers to permit the publication, reproduction, and distribution of port facility filming results, public institutions that may operate drones in port facilities with prior notice, and standards for imposition of administrative fines to ensure the fulfillment of prohibition obligations, and matters necessary for its enforcement.

2. Major Provisions

 A. Permission standards and procedures for the publication, reproduction, and distribution of port facility filming results (Article 11-2 newly inserted)

Aim to establish permission standards and procedures to prevent port security threats from being included and spreading when port facility security officers permit the publication, reproduction, and distribution of the port facility filming results, which are on key national infrastructure.

 B. Special cases concerning drone flight approval (Article 11-5 newly inserted)

Drone flights in port facilities must be approved in advance. In addition, this aims to set the scope of public institutions that may operate drones only with prior notice.

 C. Establish standards for imposing administrative fines (Attached Table 2 revised)

Aim to ease the burden on port facility owners, abolish the standards for imposing administrative fines for the violation of the obligation to keep originals of the statement of compliance of a port facility, etc., and to establish standards for imposing fines for any operation of a drone and publishing, copying, and distributing port facility filming results without permission from the port facility security officer.
