Reasons for Proposal

The current Act prescribes that a person who carries out the metrical control of special nuclear materials as an employee of a nuclear energy-realted business operator and a person who is in charge of a research project involved in the process or system development related to nuclear fuel cycle shall undergo the education on nuclear power control; and that a person who fails to receive such education is subject to an administrative fine of not more than 30 million won.

Although there are many reasons that a person subject to education on nuclear control fails to receive the education concerned, such as overseas business trips, appointment transfer, performance of other duties, it is unreasonable to impose an administrative fine on an individual subject to education.

Accordingly, this Amendment aims to improve an unreasonable part of education by requiring a nuclear energy-related business operator, etc., to educate a person subject to education on nuclear control (Article 106 (3) and Article 119 (1) 7).

Major Provisions

Nuclear energy-related operators and organizations conducting nuclear research should provide persons prescribed by Presidential Decree the education on nuclear control as prescribed by Ordinance of the Prime Minister (Article 106).

A person who fails to provide education on nuclear control in violation of Article 106 (3) shall be subject to an administrative fine of not more than 30 million won (Article 119).
