Reasons for Proposal

Currently, Article 8 (Prohibition against Dumping Wastes) of the Wastes Control Act only prohibits the dumping of household wastes in an area that has not been designated as a disposal place.

However, there are no pertinent regulations concerning the dumping that does not comply with the established disposal method such as the use of a standard waste bag, which sparks disputes over legal interpretation and provokes criticism that the punishment for violations of the disposal method is not heavy enough.

Compare, for example, the act of disposing of household waste in a standard waste bag in a place not designated as a disposal place with that of disposing of the same amount of household waste in an ordinary waste bag in a designated disposal place. The latter case is not any less than the former in a degree of infringement of public interest. However, at present, an administrative disposition may be imposed only on the former case; not on the latter case under the current law.

Accordingly, the Amendment aims to close legal loopholes by specifying relevant standards such as the methods of and the time for dumping waste, as well as stating the restrictive regulations on waste dumping places or equipment under Article 8, paragraph 1 of the Waste Control Act. (Article 8, paragraph 1)

Major Provisions

No wastes shall be dumped on a day of the week or at a time not designated by the manager, and when dumping wastes, the methods designated by the manager shall be complied with, such as using standard waste bags. (Article 8)
