Since the identification system of a message board was ruled unconstitutional on account of the infringement of freedom of expression, the issue of onlline comments, exploiting the anonymity of information and communications networks, has emerged as a serious social problem. Fake news and malicious comments followed by the manipulation of online comments using macro techniques are causing confusion on the Internet, but still, there is no penal provision as to such acts.
Therefore, this Amendment aims to prevent the manipulation of online comments posted on the articles circulated through portals to distort public opinion; punishes violators as well as abettors by imprisonment for up to 5 years or a fine not exceeding 50 million won; and requires online media and large portals to take technical measures to prevent the manipulation of comments, thereby strengthening their responsibility to create a healthy online environment (Article 44-11 newly inserted and Article 70).

Prohibit the posting or manipulation of comments on an online news service with the intention of manipulating public opinion or harming others’ reputation (Article 44-11, paragraph 1)
Impose an obligation on information network service providers and Internet media to take technical measures to prevent the posting or manipulation of specific comments (Article 44-11, paragraph 2)
