Reasons for Proposal
Though the current Act prohibits employers from forced labor against the will of a worker and unfair dismissals, such as dismissal, layoff, and suspension of workers without justifiable reasons, it does not clearly stipulate compensation for damages incurred when an employer violates this.
Therefore, this amendment aims to provide effective remedies for the infringement of workers' rights by requiring punitive damages compensation to an employer who violates the relevant provision and to contribute to the prevention of recurrence of violations of the Act (Article 92-2 newly inserted).
