Reasons for Proposal

According to the current Act, a person who imports, manufactures, or sells products (hereinafter referred to as “manufacturer, etc.") shall comply with standards for the quality of packaging materials and packaging methods to control the generation of packaging waste and facilitate the recycling of packaging waste, and the Minister of Environment shall advise manufacturers, etc., to indicate the packaging method and the quality of packaging materials on the surface of the packaging.

Also, to control the generation of packaging waste and facilitate the recycling of packaging waste, it is necessary to mandate the indication of packaging materials and packaging methods so that manufacturers, etc., voluntarily provide information related to packaging to consumers to reduce packaging waste as well as ensure that packaging standards are being complied with.

Therefore, this amendment aims to control the generation of wastes and facilitate recycling by changing the “advised packaging indication” for packaging methods and packaging materials under the current Act to “mandatory packaging indication,” and requiring the Minister of Environment to check the compliance and indication suitability through regular investigations and inspections of goods on the market every year with specialized agencies determined by Ordinance of the Ministry of Environment (Article 9 (4), (5), and Article 41 (2)).

Major Provisions

Impose the indication obligation on the surface of packaging on a person who imports, manufactures, or sells products, and impose an administrative fine for a violation of the obligation (Article 9 (4), (5), and Article 41 (2)).
