Reasons for Proposal

The current Act allows the Minister of Land, Infrastructure and Transport to measure the intake and use of alcohol, narcotics, and hallucinogens (hereinafter referred to as "alcohol, etc.") by pilots and to cancel the air operator certificate or order the operation of aircraft to be suspended for an air operator that has allowed any of its pilot to engage in aviation when he/she is unable to normally perform aviation duties because of being under the influence of alcohol, etc.

However, as the restriction on the intake and use of alcohol, etc., by pilots of aircraft used by foreign providers of international air transport services is not clearly prescribed, the legal grounds for measuring and sanctioning pilots of aircraft concerned at domestic airports is insufficient.

Therefore, the Amendment aims to set forth that the matters on the intake and use of alcohol, etc., by pilots of aircraft used by foreign providers of international air transport services to adopt the applicable provisions of the current Act, and allow the Ministry to order the suspension of aircraft operation for a foreign provider of international air transport services that has allowed any of its pilot to engage in aviation when he/she is unable to normally perform aviation duties because of being under the influence of alcohol, etc., thus protecting the public using the international transport aircraft and strengthening aviation safety (Article 105 (1) 6 and Article 106 (2) newly inserted).
