According to the “Reinforcement of Restrictions on the Rental and Mediation of National Professional Certificates” (Dec., 2018) recommended by the Anti-Corruption and Civil Rights Commission, the Amendment aims to improve and supplement some loopholes found in the operation of the current system by means such as formulating a basis for sanctions against those who lend and mediate the qualification certification of aircraft pilots. 

Details

A. Prohibition on the rental or the mediation of rental of the qualification certificates for aircraft pilots, etc. (Article 38-2 and Article 112-2 newly inserted and Article 125)

Establish the basis to prevent any person from lending or mediating the rental of qualification certificates for aircraft pilots, etc. to others.

B. Establishment of provisions on the measures against those who lend or mediate the rental of qualification certificates for aircraft pilots, etc. (Article 43 and Article 114)

Where a person has lent or mediated the rental of the qualification certificates for aircraft pilots, etc. to others, establish the basis basis to revoke the said qualification certificates. 

C. Establishment of a basis for the delegation of formulating the criteria for administrative measures for light aircraft pilots (Article 125)

Establish the basis for delegation under the statute for the criteria on the administrative measures for ultra-light aircraft pilots who have previously operated without any basis delegated under the ministerial ordinances in the statutes.
