Reasons for Proposal

The current Act requires that the opinions of relevant experts and interested parties be heard when issuing or canceling an air transport service license, and the subordinate Decree requires the Minister of Land, Infrastructure and Transport to organize an advisory meeting of up to 12 people including private experts to make decisions after hearing their opinions.

However, since the decision on whether to issue and cancel the air transportation service licenses not only requires objective, technical, and professional judgment, but also has a strong public interest character as it is related to national economic policy and public safety, it is pointed out that the composition of the deliberation body and major deliberation procedures need to be determined by Act.

Therefore, this amendment aims to maintain order and promote the sound development of air transportation services by establishing the Air Transport Service License Deliberation Committee under the Minister of Land, Infrastructure and Transport and stipulating the provisions of the legal fiction of public officials for members other than public officials in the composition of the committee, exclusion and evasion of a member, preparation of minutes, and application of penalties to deliberate on matters related to the issuance and cancellation of domestic and international air transport service licenses (Article 7 (5), Article 9-2, Article 9-3, etc.).
