Reasons for Proposal
The current Act requires the employer to investigate any workplace bullying case. However, the one who receives a report and investigates a case is the employer in the same workplace, and if the employer is involved in the bullying case, there is no mechanism to address such situation.
This Act aims to require the employer to report the outcome of actions taken to the Minister of Employment and Labor or labor inspector as defined by the Ordinance of the Ministry of Employment and Labor, and specify prohibited actions to protect victim workers and impose administrative fines on the employer who violates the foregoing (Articles 76-3 (2) and 116).
