Reasons for Proposal

Under the current Act, the head of a Si/Gun/Gu, who has authority to formulate improvement plans, selects the safety inspection institution. Nevertheless, it has been pointed out that the head of a Si/Gun/Gu has a close relationship with a reconstruction project association, which makes it difficult to ensure the safety inspection institution’s independent activity. As there is no punishment for a poorly written safety inspection report, it is difficult to ensure the fairness and objectivity of safety inspection.

In addition, there is a problem that association members who are acknowledged as an exception for housing supply under the Housing Act may be recognized to receive a housing unit even though they have not lived in the unit.

In this regard, this Act aims to require the Mayor/Do Governor to select the safety inspection institution, reinforce punishment for a poorly written safety inspection report, and allow association members to file an application to purchase a housing unit if they have lived in the unit for 2 years or more for a reconstruction project in any high-speculation area.

Furthermore, this Act also aims to allow the passage of a resolution electronically in the event that it is difficult to physically attend a general meeting and pass a resolution due to any disaster such as the spread of an infectious disease, and supplement and systematically manage shortcomings found in the current system by allowing the Minister of Land, Infrastructure and Transport to directly establish and operate the improvement projects management system and outsource the system if necessary.

Details

A. Require the Si/Do to request safety inspection at the request of the Si/Gun/Gu, ban any falsely or poorly written safety inspection report, and limit bidding and impose administrative fines for any violation (Articles 12, 13, and 140 and Articles 12-2 and 113-4 newly inserted)

B. Allow association members to file an application to purchase a housing unit if they have lived in the unit for 2 years or more years for a reconstruction project in any high-speculation area, put in place limited exceptions for cases where they cannot live in the unit, and set forth a provision that punishes any association member who files an application through any unlawful method (Articles 39, 72, 73 and 136)

C. Allow the passage of a resolution electronically in the event that it is difficult to physically attend a general meeting and pass a resolution due to any disaster (Article 45)

D. Allow the Minister of Land, Infrastructure and Transport to directly establish and operate the improvement projects management system and request documentation required for its operation (Articles 119 and 128)
