Reasons for Proposal

While automated driving technology, one of the key areas in the 4th Industrial Revolution, is evolving into safer “cooperative automated driving” in cooperation with road infrastructure, the risk of hacking on expanding intelligence and connectivity in vehicles may pose a threat to people’s life and safety.

In this regard, while a cooperative automated driving certification management system is needed to ensure reliability and anonymity in telecommunication messages between devices on the road and vehicles and lay a safe operation foundation for autonomous vehicles, the current law lacks a legal basis to establish and operate such a system.

Accordingly, this Act aims to ensure safety and reliability in the cooperative automated driving system by preparing a legal basis to establish and operate a certification management system intended to make sure safety in autonomous vehicles.

Details

A. To establish and operate a cooperative automated driving certification management system, grant the Minister of Land, Infrastructure and Transport the highest certification authority to manage, supervise, and operate the certification management system, conduct related work, and establish and operate a cooperative automated driving certification management center (Article 27).

B. Allow the Minister of Land, Infrastructure and Transport to designate an individual considered capable of doing cooperative automated driving certification work while ensuring the safety and reliability as a certification agency, and publish qualification requirements for a certification agency (Article 28).

C. To specify the requirements that the certification agency is required to meet in performing cooperative automated driving certification work, require the Minister of Land, Infrastructure and Transport to determine and publish cooperative automated driving certification management standards including certificate management, identification and proof information management, facility and equipment protection, and fee policy (Article 29).

D. Require the certification agency to prepare cooperative automated driving certification rules including types of cooperative automated driving certification based on certification management standards and cooperative automated driving certification methods and procedures before initiating certification work and report them to the Minister of Land, Infrastructure and Transport (Article 30).

E. To ensure the certification agency’s safe cooperative automated driving certification work, impose obligations on the certification agency to prepare safety protection measures for certification facilities and equipment, and give the Minister of Land, Infrastructure and Transport the authority to conduct regular inspection and request documentation (Article 33).

F. To operate and manage the system that provides cooperative automated driving certification work in a stable manner, require the certification agency to establish a failure prevention/response plan including how to detect and manage risk and prepare restoration measures (Article 34).

G. In the event that the certification agency causes damages to members or users with regard to cooperative automated driving certification work, impose liability on the certification to compensate for such damages (Article 38).
