Reasons for Proposal

The current Act requires regular inspection every 2 years, 4 years after release for non-commercial vehicles and every 1 year, 2 years after release for commercial vehicles.

However, as there is no legal basis that allows cancelation of registration for vehicles which do not receive regular inspection, the number of vehicles not receiving regular inspection for more than 10 years has reached 600,000.

In this regard, this Act aims to allow Mayor/Do Governor to cancel the registration of any motor vehicle that continues to operate after being suspended from operation for not receiving regular inspection or comprehensive motor vehicle inspection, which forces such inspection upon any vehicle whose safety has not been verified since it has not received a regular inspection. An increase in administrative fines from up to 500,000 won to up to 1 million won shall be imposed on motor vehicles that do not receive inspection to improve the effectiveness of the law, and supplement and improve shortcomings observed in the current system.

In addition, since bad practices have not been eradicated as designated maintenance business entities just let motor vehicles pass inspection or ignore illegal motor vehicles, this Act aims to increase the re-designation restriction period for designated maintenance business entities whose designation has been canceled or the re-appointment restriction period for skilled technicians who have been dismissed in an effort to prevent illegal or inadequate inspections and therefore contribute to safer motor vehicle driving.

Furthermore, this Act aims to ease the burden on drivers who want to receive motor vehicle inspection by abolishing obligations to present their motor vehicle registration certificate during inspection, and contribute to preventing motor vehicle accidents and improving air quality by introducing training for skilled technicians in motor vehicle inspection to improve their inspection skill and conduct accurate inspections.

Details

A. Prepare the basis that allows a Mayor/Do Governor to cancel the registration of any motor vehicle that continues to operate after being suspended from operation for not receiving regular inspection or comprehensive motor vehicle inspection (Article 13 paragraph 3 subparagraph 5).

B. Require the head of a Si/Gun/Gu to order the suspension of the operation of any motor vehicle that has not complied with an order to receive inspection, and follow applicable provisions on a mutatis mutandis basis for compliance after an operation suspension order (Article 37 paragraphs 3 and 4).

C. Abolish a provision that makes it mandatory to check a motor vehicle registration certificate and record the results of motor vehicle inspection on the certificate (Article 43 paragraphs 2 and 3).

D. Strengthen the re-designation restriction period for designated maintenance business entities whose designation has been canceled or the re-appointment restriction period for skilled technicians who have been dismissed (Article 45 paragraph 5 and Article 46 paragraph 3).

E. Prepare the basis to introduce mandatory training for skilled technicians in motor vehicle inspection to improve their inspection skill (Article 46-2 newly inserted).

F. Newly insert the punishment of up to 1 year in prison or up to 10 million won in fines for those who drive a motor vehicle in violation of an operation suspension order, and increase administrative fines from up to 500,000 won to up to 1 million won imposed on motor vehicles that do not receive an inspection (Articles 81 and 84).
