Reasons for Proposal

The current Act requires any product importer/manufacturer (“manufacturers and others”) to comply with packaging material and method standards to discourage packaging waste and promote recycling, and the Minister of Environment recommends manufacturers and others to label its packaging material and method on the package.

To discourage packaging waste and promote recycling, it is necessary to require manufacturers and others to not only comply with packaging standards but also receive preliminary inspection on packaging materials and methods before launching their product and provide consumers with inspection results on their package.

Hence, this Act aims to require manufacturers and others to receive inspection on packaging materials and methods from the specialized agency as prescribed by Ordinance of the Ministry of Environment before launching their product and provide inspection results on their package, and impose punishment on those failing to receive such inspection or falsifying inspection results to prevent packaging waste (Article 9 paragraphs 3 through 5, and Article 39-2 paragraph 1 and Article 41 paragraph 2 subparagraph 2-2 newly inserted).


Major Provisions

Require manufacturers and others to receive inspection on packaging materials and methods from the specialized agency as prescribed by Ordinance of the Ministry of Environment before launching their product and provide inspection results on their package (Article 9).
