Reasons for Proposal

Currently, passengers’ resident registration card and passport are checked at the airport as part of the procedure to ensure safety and security for passengers. If passengers do not comply, penalties are taken such as banning them from boarding the aircraft.

However, while the current Act specifies measures for aviation security by the airport operator and aircraft operator, the procedure where passengers are identified and they present their ID card is not explicitly specified in the Act even though it is a matter related to limiting their rights or imposing obligations. Hence, some have pointed out that the foregoing should be specified in law.

In this regard, this Amendment aims to resolve this legal shortcoming and ensure effectiveness for penalties by newly inserting passengers’ obligations to carry and present their ID certificate and other matters related to their identification and punishing any passenger who provides any falsified or modified ID certificate or uses someone else’s ID certificate illegally (Article 15-2 newly inserted, etc.).
