Reasons for Proposal

The current Act states that no employer shall unfairly give discriminatory treatment to a foreign worker on the grounds that he/she is a foreign worker. However, it has been continuously reported in the media about employers delaying payments to employed foreign workers or sexually harassing them.

To improve the treatment of foreign workers, it is suggested that it is necessary to not just provide a declaratory provision in law but make it obligatory to provide training to employers hiring foreign workers so that their perception about the human rights of foreign workers can change.

In this regard, this Act aims to obligate employers who receive a foreign worker employment permit for the first time to attend training about the human rights of foreign workers and working condition improvements, and impose up to 5 million won in fines on employers for failing to attend such training in an effort to raise awareness about foreign workers among employers and better protect foreign workers (Articles 22-3 and 32).
