Reasons for Proposal

The current Act allows the Minister of Land, Infrastructure and Transport to search the criminal records of those who have acquired the qualifications for driving in the passenger transport business and engage in the driving business (transport employees), and if an employee is found to have committed sexual crimes, etc., to enforce follow-up measures such as informing the mayor or do governor and the transport business entity to cancel or suspend his/her qualification. 

In this regard, the current Act does not provide provisions to check the criminal records, etc. of those who have acquired the qualifications for driving but are not yet engaged in the driving business or have retired, and thus some argue that it is difficult to prevent sex offenders, etc. from becoming taxi or bus drivers, thus threatening the safety of passengers. 

Therefore, the Amendment aims to allow the Minister of Land, Infrastructure and Transport to request data on the criminal records of those who are qualified to drive in the passenger transport business from the Commissioner of the National Police Agency, thereby preventing sex offenders, etc. from becoming transport workers and securing the safety of passengers using transportation (Article 79-2 newly inserted).
