Reasons for Proposal
The use and operating hours of micro enterprises are restricted to prevent the spread of COVID-19 based on Article 49 paragraph 1 subparagraph 2 of the Infectious Disease Control and Prevention Act.
However, some argue that as there is no legal provision that compensates for micro enterprises for restricting their business, it is not consistent with the intents of Article 23 of the Constitution and violates the principles of legal clarification.
In addition, according to many experts, global pandemics such as COVID-19 will occur again, and some even forecast that they may occur more frequently. Hence, the government needs to establish a systematic compensation scheme for micro enterprises who suffer losses due to a ban on gatherings or a restriction on business, which is implemented when a new infectious disease, not just COVID-19, spreads.
In this regard, this Act aims to explicitly prepare a basis for compensating micro enterprises who suffer losses due to a ban on gatherings or a restriction on business as a result of a spreading infectious disease (Articles 12-2 through 12-4 newly inserted).
