Reasons for Proposal

The current Act defines the establishment of a good working environment that can reduce physical fatigue and mental stress for employees and improve working conditions as one of the obligations of employers. In addition, the Rules on Occupational Safety and Health Standards require employers to prepare rest facilities that employees can use during their breaks.

Nonetheless, the current Act has no provision that obligates the installation of rest facilities, as well as no punishment. Consequently, some point out that rest facilities are not installed at work or poor rest facilities are provided to workers.

In this regard, this Act aims to explicitly state the installation of rest facilities as the obligation of employers and prepare a basis that allows the Minister of Employment and Labor to check and inspect the operational status of rest facilities to ensure appropriate rest facilities in the workplace (Articles 128-2 and 128-3, newly inserted).
