Reasons for Proposal

Recently, the sharing economy where people share resources such as products, places, and information is growing rapidly. Many local governments have prepared and implemented ordinances to support and manage the sharing economy. However, there is no legal framework at the national level to support and manage the sharing economy, which makes it difficult to act proactively in line with new changes in the 4th Industrial Revolution and support new types of businesses, means, or services.

Car sharing, one of the models in the sharing economy, is recognized as a means to solve environmental pollution, traffic congestion, and parking problems through the introduction of regulations and rules and needs to be actively supported to effectively manage transport demand. Article 6-2 of the Enforcement Rule of the Parking Lot Act also defines the installation of exclusive parking areas to support car sharing.

Despite this provision to support car sharing, however, there are administrative cases that are not consistent with it. Some local governments interpret that car sharing services use public parking areas for purposes other than parking and ban the vehicles for the services from entering public parking lots, which cause inconveniences for people who use such services.

In this regard, it is necessary to amend applicable laws, clarify a provision on car sharing vehicles in the Parking Lot Act, and prepare administrative support policies for a new mobility environment.

This Act aims to newly insert a provision that defines car sharing vehicles, ensures spaces to use car sharing services, and prepares a provision for administrative support to facilitate support for car sharing (Article 2, subparagraph 14 newly inserted).
