Reasons for Proposal

According to Article 2, subparagraph 3 (b) of the Living Logistics Service Industry Development Act, which is to be enforced on July 27, 2021, the package delivery agency service business is defined as a business that directly delivers cargo using motorcycles or brokers it using an information and communication network, etc., pursuant to Article 3 (1) 5 of the Motor Vehicle Management Act.

However, since delivery and courier transportation is limited to trucks and motorcycles, there is an opinion that grounds should be established, as in the Trucking Transport Business Act, for deliveries to be made using an electric scooter, car, or walking by adding them to the methods, and making inquiries to the Commissioner General of the National Police Agency about the criminal records of the drivers of the living logistics service to protect customers who use living logistics from crime.

Therefore, this amendment aims to promote the rights and interests of consumers and workers in package delivery agency services by adding electric scooters, walking, etc., to the existing motorcycles for transport means and methods, which are prescribed by Presidential Decree, for the package delivery agency service business and by allowing inquiries to the Commissioner General of the National Police Agency about the criminal records of persons who are engaged in package delivery agency services (Article 2, subparagraph 3 (b) and Article 17-2, newly inserted).
