Reasons for Proposal

The number of drivers serving in the delivery industry is on the rise as the delivery industry is booming due to enhanced measures aimed at containing COVID-19 such as social-distancing measures. However, due to the inherent nature of the delivery business, the drivers are likely to meet face to face with customers and since they can easily acquire the personal information of customers such as customers’ address or family information, there is a growing concern over the possibility of crimes being committed by delivery drivers. 

On the other hand, under the “Act on the Protection of Children and Youth against Sex Offenses,” employment of ex-convicts of sex crimes is restricted in 37 industries, including child education institutions, cultural and sports facilities, and medical institutions, where they may encounter children and youth, but since there is no restriction on the employment of delivery drivers, some point out that the industry creates a “blind spot for the employment of sex offenders.” 

However, while restrictions are in place for the employment of sex offenders under the “Trucking Transport Business Act” revised in 2019, there are no regulations restricting the employment of violent crime offenders or sex offenders for the delivery services using two-wheeled motor vehicles (motorcycles), giving rise to the issue that everyone is allowed to work as a delivery driver regardless of one’s criminal record. 

Therefore, the Act aims to impose restrictions on sex offenders, etc. working as drivers as in the “Trucking Transport Business Act” so as to allow users of delivery agency services to feel safe when using the service (Article 17-2 newly inserted).
