The current act prescribes that the system make safe building dismantling sites by the method wherein a building dismantling plan shall be established and submitted together with a statement of dismantling method to the permission-granting authority before dismantling a building and the dismantling work supervisor shall check and control building dismantling sites.

Meanwhile, an accident recently occurred in Gwangju Metropolitan City, and a 5-story commercial building collapsed on a stopped city bus during dismantling work, resulting in damages to the driver and passengers; in 2019, a similar accident occurred in Jamwon-dong, Seoul. As safety accidents continue in relation to building dismantling, there are opinions that the current system requires supplementation.

Therefore, the draft is aimed at securing the effectiveness of the current system for dismantling site safety control and creating safe building dismantling sites by the method wherein full-time supervision system is applied by designating supervisor(s) during the entire period of work in case of dismantling work prescribed by the Presidential Decree, the person who prepared a wrong dismantling plan is punished by imprisonment for one (1) year or less or fine of KRW 10 million or less, and the person who caused public danger due to unfaithful execution of the dismantling plan is punished by imprisonment for ten (10) years or less or fine of KRW 100 million or less.
