Reasons for Proposal and Major Provisions


Since the lottery business is a public service that supports the low-income bracket, persons of national merit, the neglected group of people, etc. with funds raised by the State through lottery sales, strict blocking of similar and unfair acts is necessary. 

However, unlike other gambling industry-related laws such as the National Sports Promotion Act, the Korea Racing Association Act, Bicycle and Motorboat Racing Act, etc. the current law does not prohibit or punish similar or unfair acts. Thus, activities like operating illegal lottery internet sites by copying lottery businesses’ sites or impersonating partnerships, defrauding investments or deposits, receiving payment for providing expected lottery numbers that are merely determined independently for each lottery, and acting as proxy for the selling domestically or purchasing of overseas lottery tickets are similar and unfair acts related to the lottery, and they increase the damage to the public, which is the consumer of the lottery, and also tarnish the image of the lottery, which is used as a public service resource. 

Hence, as in other gambling industry-related laws, the government intends to ban similar or unfair lottery-related acts and punish them for violating them to make the national lottery business sounder (Article 5-3, Article 34 (1) 4, Article 34 (3) 2 and 3 newly inserted).
