Reasons for Proposal and Major Provisions

In the current law, the Minister of Land, Infrastructure and Transport allowed the introduction of a certification system for automobile tuning parts, and the enforcement rules stipulate specific details for tuning parts certification to secure safety for automobile tuning. Accordingly, if the performance and quality of the automobile tuning parts are certified, the consumer can purchase the tuning parts and tune the automobile without going through a separate tuning approval procedure. 

However, it has been pointed out that under the current law there is no basis for sanctions even if parts are sold after being certified by illegal means, and that there are no explicit or specific standards related to the tuning certification system. Hence, improvement is needed.

Accordingly, by preparing a specific basis for performance and quality certification of automobile tuning parts and imposing fines on those who sell them in spite of their knowledge that they are false, this amendment aims to improve and supplement some of the inadequacies discovered during the operation of the current system, such as rationally improve the tuning part certification system (Articles 34-3 and 34-4 newly inserted).
