Reasons for Proposal
The current Act bans requiring any job applicant to provide the applicant’s physical conditions, such as appearance, height, and weight, place of birth, marital status, and property as well as any academic background, occupation, and property of his or her lineal ascendants or descendants and siblings in basic examination materials or collecting such information as evidentiary materials.
In the meantime, many female job applicants are still often asked about personal information for their family situation such as whether they have children, the number of children they have, the age of their children during the hiring procedure including interviews, and there exists discrimination against female job applicants who have young children.
In this regard, this Act aims to add the family status including “whether the job applicant has a child, and the age and number of children” to personal information that must not be requested during the hiring procedure including interviews in an effort to enhance fairness in hiring (Article 4-3).
Major Provisions
Prescribe that personal information such as “whether the job applicant has a child, and the age and number of children” shall not be obtained from job applicants during the hiring procedure including interviews (Article 4-3).
