Reasons for Proposal

The current Trucking Transport Business Act restricts employment as couriers for any persons with a criminal record involving sex or violence, but there lacks any explicit provision on an employment restriction regarding courier agents (package delivery agency service workers).  With the rising use of delivery agencies (certified package delivery agency service providers), the public’s concerns over crimes involving delivery agents have been on the rise.  

In October 2019, a petition calling for “measures to prevent sex offenders from working as delivery service providers,” which was registered in the National Petition of Cheong Wa Dae in October 2019, obtained the consent of 31,051 people, and in February 2021, a case in which a delivery agent committed an obscene act against a woman at an officetel elevator made the news.   Reflecting the severity of public opinion, the Anti-Corruption & Civil Rights Commission has proposed to the Ministry of Land, Infrastructure, and Transport to consider restricting the employment of persons with a history of sexual and/or violent crimes as delivery agents to relieve anxiety among single-person and female households.

Therefore, the Act aims to prevent persons with a history of sexual and/or violent crimes from engaging in the package delivery agency service and to require certified package delivery agency service providers and business establishments to verify the criminal records involving sex and/or violence when signing a consigned transportation agreement or employment agreement with a delivery agent. 

Details

A. Revoke the certification of a certified package delivery agency service provider that employs persons with a history of sexual and/or violent crimes (Article 19).

B. Prevent any persons with a history of sexual and/or violent crimes from working as a package delivery agency service worker (Article 19-2 Paragraph 1).

C. Require certified package delivery agency service providers or business establishments to request the head of the relevant authority to conduct a search of criminal records when hiring a package delivery agency service worker (Article 19-2 Paragraph 2).

D. Require the Minister of Land, Infrastructure and Transport to request certified delivery agency service providers or business establishments to terminate consigned transport agreements or employment agreements with sex offenders or violent crime offenders (Article 19-2 Paragraph 3).
